Phoenix Flowers Floral Boutique is a brand operated by Flowers Today LLC, an Arizona limited liability company. For purposes of this policy, references to “Phoenix Flowers Floral Boutique,” “Phoenix Flowers,” “Flowers Today LLC,” “we,” “us,” or “our” refer to Flowers Today LLC, which operates the Phoenix Flowers Floral Boutique website and provides the products and services offered through it.

These Terms & Conditions (“Terms”) govern your access to and use of our website, products, flower delivery services, and related services. By accessing our website, placing an order, or otherwise using our services, you agree to these Terms.

If you do not agree to these Terms, please do not use our website or services.

1. Our Services

Phoenix Flowers Floral Boutique provides floral arrangements, plants, gifts, and related products for delivery to recipients in supported delivery areas.

Orders may be prepared and/or delivered by Flowers Today LLC, independent local florists, floral fulfillment partners, delivery providers, or other third-party service providers selected to fulfill the order.

Availability of products, flowers, containers, gifts, and delivery services may vary depending on the recipient's location, season, local inventory, weather conditions, holidays, and other circumstances.

2. Placing an Order

When placing an order, you agree to provide accurate and complete information, including your contact information, billing information, recipient's name, delivery address, recipient's telephone number, requested delivery date, and any other information necessary to complete the order.

You are responsible for verifying that all information submitted with your order is correct.

Flowers Today LLC is not responsible for delays or failed deliveries caused by incorrect, incomplete, or outdated information provided by the customer.

We reserve the right to accept, decline, cancel, or request additional information regarding an order when reasonably necessary, including for payment verification, fraud prevention, product availability, or delivery limitations.

3. Product Availability and Floral Substitutions

Flowers and plants are natural, seasonal products, and availability may vary significantly by location and time of year.

The arrangement delivered may therefore differ from the photographs displayed on our website.

When particular flowers, colors, containers, vases, plants, or other components are unavailable, we or the fulfilling florist may make substitutions of comparable style, quality, and value while attempting to preserve the overall appearance, color palette, and character of the arrangement.

For example, a specific variety or shade of rose may be substituted with another comparable rose, or a pictured vase may be replaced with a similar container of comparable value.

During major floral holidays and periods of unusually high demand, including Valentine's Day and Mother's Day, substitutions may be more extensive due to limited local availability.

By placing an order, you acknowledge and accept that reasonable substitutions may be necessary.

4. Product Images

Product photographs displayed on our website are representative examples.

Because each floral arrangement is individually prepared using natural products, no two arrangements will be exactly identical. Differences in flower size, color, maturity, shape, stem count, placement, greenery, and overall appearance are normal.

Colors may also appear differently depending on your screen or device.

Accordingly, the delivered arrangement is not guaranteed to be an exact reproduction of the arrangement shown in a product photograph.

5. Prices and Payment

Flower subscriptions

Subscription prices are per delivery. Choose weekly, every-two-week or monthly deliveries and a first delivery date. Monthly deliveries use the same calendar day, or the last day of a shorter month. Standard delivery is included; the sales tax and total per delivery are shown before you authorize your saved card.

Setting up a subscription saves your card securely with Square and does not charge it. By selecting the subscription authorization checkbox, you authorize Phoenix Flowers to charge the agreed per-delivery total when we begin preparing each scheduled bouquet. We do not charge simply because a date appears on the calendar. If payment is not confirmed, preparation does not begin.

The agreed subscription price is retained for that subscription; changing the advertised plan price applies to new subscriptions. You can cancel future deliveries and their charges before preparation begins at Manage your subscription, using your subscription number and email. Orders whose preparation has already started remain separate orders; contact our team for help with them.

All prices are displayed in U.S. dollars unless otherwise indicated.

The total amount charged may include the product price, delivery charges, service fees, taxes, and any other applicable charges disclosed during checkout.

You agree to pay the total amount displayed and accepted at checkout.

We may change product prices, fees, promotions, or discounts at any time. Changes will not normally affect an order that has already been accepted and paid for, except where correction is required because of an obvious pricing or technical error.

Payment must be made using one of the payment methods available during checkout.

By submitting payment information, you represent that you are authorized to use the selected payment method.

6. Pricing and Website Errors

We attempt to provide accurate product descriptions, pricing, availability, and other information. However, typographical, technical, pricing, or other errors may occasionally occur.

If an order is affected by a material pricing or listing error, we reserve the right to contact you to correct the order or cancel it and issue an appropriate refund.

We are not obligated to fulfill an order at an obviously erroneous price.

7. Delivery

We will make reasonable efforts to deliver orders on the requested delivery date. However, unless we expressly guarantee otherwise, a requested delivery date or time is an estimate and is not an absolute guarantee.

Delivery may be affected by circumstances including weather, traffic, holidays, high order volume, florist availability, courier availability, incorrect recipient information, restricted-access locations, and circumstances outside our reasonable control.

Exact delivery times are generally not guaranteed unless expressly stated during checkout.

For residential deliveries, an arrangement may, when reasonably appropriate, be left in a safe location, with a neighbor, building representative, concierge, front desk, or another appropriate person if the recipient is unavailable.

The recipient may also be contacted to coordinate delivery.

8. Hospitals, Funeral Homes, Businesses, Hotels, and Other Facilities

Deliveries to hospitals, funeral homes, schools, hotels, businesses, military facilities, gated communities, nursing facilities, and other restricted locations are subject to the rules and access requirements of those facilities.

We cannot guarantee direct delivery to a particular room, patient, employee, guest, or individual when facility rules require delivery to a reception desk, mailroom, security desk, funeral director, nursing station, or another designated receiving area.

Customers are responsible for providing accurate facility information, including the recipient's full name and any relevant room, department, service, or organization information.

9. Recipient Contact

You authorize Flowers Today LLC, our fulfilling florist, and our delivery partners to contact the recipient when reasonably necessary to complete the delivery.

Contact may be necessary to confirm the address, obtain access instructions, determine whether someone is available to receive the order, arrange redelivery, or resolve another delivery-related issue.

We will make reasonable efforts to preserve the surprise nature of an order when practical, but successful delivery may require contacting the recipient.

10. Incorrect or Incomplete Delivery Information

Customers are responsible for providing a complete and accurate delivery address and recipient contact information.

If an order cannot be delivered because the customer provided an incorrect or incomplete address, additional delivery charges or redelivery fees may apply.

Once an order has been delivered to the address provided by the customer, Flowers Today LLC is generally not responsible for loss, theft, damage, or inability of the intended recipient to retrieve the order.

11. Changes and Cancellations

If you need to change or cancel an order, please contact us as soon as possible.

We will make reasonable efforts to accommodate your request. However, changes and cancellations are not guaranteed once an order has been prepared, assigned to a florist, dispatched for delivery, or delivered.

Orders involving custom arrangements, special-order merchandise, or products purchased specifically to fulfill the customer's request may not be eligible for cancellation once preparation has begun.

12. Freshness and Product Concerns

Flowers are perishable natural products, and their appearance and lifespan depend on factors including flower variety, temperature, environment, transportation, and care after delivery.

If you believe an arrangement arrived damaged, significantly below reasonable quality expectations, or materially different from the product ordered beyond reasonable floral substitutions, please contact us promptly.

We may request photographs of the delivered arrangement or other information reasonably necessary to evaluate the issue.

Depending on the circumstances, we may offer a replacement, partial refund, full refund, store credit, or another appropriate resolution at our discretion and as required by applicable law.

Claims concerning the condition of fresh flowers should generally be reported as soon as reasonably possible after delivery so that we can properly investigate the issue.

13. Non-Edible Products and Safety

Unless a product is expressly identified by Flowers Today LLC as edible or intended for human consumption, all flowers, plants, greenery, decorative berries, floral materials, arrangements, and related decorative items sold or delivered by Phoenix Flowers Floral Boutique are intended for decorative purposes only and are not intended for human or animal consumption.

Customers and recipients should not eat, taste, ingest, or otherwise consume any part of a floral arrangement. Certain flowers, plants, greenery, decorative materials, floral preservatives, and other components may be toxic, harmful, or capable of causing allergic or adverse reactions if ingested or improperly handled.

Customers and recipients are responsible for keeping floral arrangements and their components away from children and pets when appropriate. Flowers Today LLC does not represent that any flower, plant, or other component of an arrangement is safe for consumption by humans or animals unless expressly stated otherwise.

To the fullest extent permitted by applicable law, Flowers Today LLC, doing business as Phoenix Flowers Floral Boutique, is not responsible for illness, injury, allergic reactions, poisoning, or other damages resulting from the ingestion, consumption, misuse, or improper handling of flowers, plants, greenery, floral preservatives, decorative materials, or other non-edible components of an arrangement.

If ingestion occurs or an adverse reaction is suspected, the affected person should promptly seek appropriate medical or poison-control assistance. For suspected ingestion by a pet, contact a veterinarian or animal poison-control service.

14. Refunds

Refund eligibility is determined based on the circumstances of the order and applicable law.

Refunds, when approved, will generally be returned to the original payment method. Processing times may vary depending on the payment provider or financial institution.

Delivery charges, service fees, and other charges may be non-refundable when the associated service has already been performed, except where required by law or where the refund results from our failure to provide the applicable service.

Nothing in these Terms limits any refund or consumer right that cannot legally be waived.

15. Gift Messages

Customers may have the option to include a personal message with an order.

You are responsible for the content of any message you submit.

You agree not to submit messages containing unlawful, threatening, harassing, defamatory, discriminatory, obscene, fraudulent, or otherwise inappropriate content.

We reserve the right to refuse to transmit a message that we reasonably believe violates these Terms or applicable law.

16. Promotions and Discount Codes

Promotional offers, coupons, and discount codes may be subject to additional terms, expiration dates, minimum purchase requirements, product exclusions, delivery restrictions, or other limitations.

Unless expressly stated otherwise, promotional offers cannot be combined and have no cash value.

We reserve the right to reject or cancel promotional discounts obtained through fraud, abuse, technical errors, or unauthorized distribution.

You may use our website only for lawful personal and commercial transactions with Flowers Today LLC.

Because flowers and plants are natural and perishable products, we cannot guarantee an exact lifespan, appearance, color, or condition after delivery where those characteristics are affected by environmental conditions, recipient care, or other circumstances outside our reasonable control.

Nothing in this section excludes warranties or protections that cannot legally be excluded under applicable law.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Flowers Today LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of our website, products, or services.

To the fullest extent permitted by law, our aggregate liability arising from a particular order will not exceed the amount paid to Flowers Today LLC for that order.

These limitations do not apply where liability cannot legally be limited or excluded.

23. Force Majeure

Flowers Today LLC will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fires, floods, transportation disruptions, government actions, labor disruptions, telecommunications failures, power outages, widespread supply shortages, or other extraordinary events.

When such circumstances affect an order, we will make reasonable efforts to provide an appropriate alternative, reschedule delivery, or otherwise resolve the situation.
